“习惯”的话语表达——以法律人类学家的“言说”为考察对象

摘　　要：习惯作为一种话语,被法律人类学家广泛运用于各种法律现象与问题分析之中。法律人类学家对习惯的言说,主要从学理和案例两个层面展开。学理言说中的习惯话语,不仅关注习惯概念本身,还关注对习惯及其相近概念的关系结构分析。案例言说中的习惯,虽然意在呈现习惯的经验主义理解图式,但却更加注重对习惯价值功能及其作用机理的揭示。习惯话语的法律人类学表达逻辑,体现在注重言说的跨学科性、坚持整体观的框架,突出经验主义范式等方面。习惯的中国法律人类学言说,应考虑习惯在中国法学、人类学、法律人类学等不同知识传统中的话语内涵、习惯在何种经验中被发现与阐释,以及支撑习惯经验话语的言说逻辑。As a kind of discourse, custom is widely used by legal anthropologists in the analysis of various legal phenomena and problems. Legal anthropologists' speeches of custom are mainly from the aspects of theory and case. Custom discourse of theory speeches focuses not only on the concept of custom itself, but also on the analysis of the relationship structure of custom and its similar concepts. Custom discourse of case speeches, although intended to present the empirical understanding schema of custom, pays more attention to reveal the value function of custom and its mechanism of action. The legal anthropological expression logic of custom discourse is reflected in the interdisciplinary nature of speech, the framework of the holistic view, and the empiricism paradigm. The custom's speech of Chinese legal anthropology should take into account the discourse connotation of custom in Chinese jurisprudence, anthropology, legal anthropology, and the experience in which custom are discovered and interpreted, as well as the speech logic that supports the discourse of custom's experience.
