摘　　要：随着立法日趋完善,刑事诉讼法的法典化成为未来发展的主要趋势。顺应时代要求,刑事诉讼法将迎来第四次修改,此次修改也是刑事诉讼法法典化的重要契机。从刑事诉讼法法典化体系完备、逻辑周延、修补缺漏等角度出发,此次刑事诉讼法修改可在完善既有立法规范的基础上,围绕以审判为中心的改革、刑事程序的繁简分流和特别程序的体系化建构三个方面展开。以审判为中心的改革应重点关注无罪推定原则、直接言词原则和诉讼制度构造等基础性内容的调整;刑事程序的繁简分流有必要从量刑协商程序、自愿性审查、值班律师参与等方面优化认罪认罚从宽制度的具体适用;在探寻一般性规律的基础上,特别程序的体系化建构应从体例、逻辑结构和内容等方面进一步明确和完善各程序之间的关系。With the continuous improvement of criminal procedural legislation,its codification has become the main trend for future development.In response to the needs of the times,the criminal procedure Law will also undergo its fourth amendment,which is an important chance towards codification.Starting from the perspectives of a comprehensive system of codified criminal procedural laws,logical consistency,and deficiencies remedy,this amendment can not only improve ex-isting legislative norms but also focus on three aspects:trial-centered reform,distinctions of complex and simple criminal procedures and systematic construction of special procedures.The reformation of the trial-centralism,the amendment should put emphasis on adjusting the foundational principles such as the presumption of innocence,the principle of direct speech and the structure of procedural system.Divergence of complexity and simplicity of the criminal procedures necessi-tates optimizing the specific application of the system of leniency for pleading guilty and acceptance of punishment through aspects like sentencing negotiation procedures,voluntary reviews,and the participation of duty lawyers.Based on the ex-ploration of general principles,the systematic construction of special procedures should further clarify and improve the rela-tionships between procedures in terms of forms,logical structures,and content.
