生态环境领域行政备案的现状检视和制度完善

摘　　要：生态环境领域行政备案是专门适用于生态环境保护的行政备案类型,涵盖了内部备案与外部备案等类型,具有信息监管、风险监管、标准监督等功能。但是受规范不健全、程序机制缺乏、实践困境等因素制约,其功能难以有效发挥。实践中,应规范生态环境领域行政备案的设定机制、健全实施控制机制,推动完善生态环境领域行政备案制度;同时,可借助合作监管机制、动态监管机制、应急监管机制,强化生态环境领域行政备案的监管效能。Administrative filing in the field of ecological environment is a type of administrative filing specifically applicable to ecological environment protection,covering both internal and external filing types,with functions such as information supervision,risk supervision,and standard supervision.However,due to inadequate regulations,deficiency of procedural mechanisms,and practical constraints,its functions are difficult to effectively play.In practice,it is necessary to standardize the establishment mechanism of administrative filing in the field of ecological environment and improve the implementation control mechanism,improve the administrative filing system in the field of ecological environment.At the same time,with the help of cooperative supervision mechanisms,dynamic supervision mechanisms and emergency supervision mechanisms,we will strengthen the regulatory efficiency of administrative filing in the field of ecological environment.
