摘　　要：中国古代的法官回避制度。《唐六典》规定,若主审官员与被审者是亲戚关系,或曾为师生、官长僚佐等,或有仇怨、嫌隙,应准许其请求回避,更换他官推审。此后,历代对法官回避制度皆有规定。换推制度体现了古人的司法智慧,设置初衷与现代程序法治理念相通。This is a recusal system for judges in ancient China.The Six Statutes of the Tang Dynasty stipulated that if there had been familial relationship,teacher-student relationship,governor-assistant relationship,grudges or grievances between the presiding official and the interrogee,the court should entertain the request of the presiding official for withdrawal and designate another official to take charge.Since then,there were provisions on the recusal system in all dynasties.The system embodies ancient judicial wisdom,and its original intention is in line with the modern underpinnings of procedural law.
