摘 要:经过多年的探索与积淀,我国的证据法学教学体系已经形成了相对确定且成熟的内容板块。不过,近来的一些研究对此有一些批评性的反思。同时,从实用的角度来看,传统证据法学教学不大重视证据分析这一不足是值得进一步探讨的。文章围绕以证据分析为核心的证据法学教学设计而展开,进而讨论了在证据法学教学研究中引入“法律的社会科学研究”(法社科)方法的价值,以期在拓宽、加深我国的证据法学教学与研究上有所助益,并能对“证据法学”为何这一元问题的讨论有所加深。The pedagogic system of evidence law in China has been set up with relatively stable and mature teaching contents after years of exploration and accumulation of experience.However,recent researches have cast some critics on this view.From the practical perspective,the criticism of the traditional pedagogy of evidence law that evidence analysis has not been paid much attention,is worthy of further discussion.Therefore,this paper focuses on how to set evidence analysis as core pedagogy in evidence law teaching.It also demonstrates the value of introducing the method of social science study of law(Socio-Legal Approach)into the teaching and academic research of evidence law.It is expected that this paper may help broaden and deepen the teaching and research of evidence law in China,and provide some beneficial insights into the meta-question of what evidence law is.
