探究电信网络诈骗犯罪治理模式——以被害预防为路径

摘　　要：面对电信网络诈骗犯罪,应针对被害人的被害性,以被害预防为路径构建新的电诈犯罪治理模式。当前我国被害预防工作面临宣传教育流于形式导致实效性降低、预警干预乏力导致成功率低下、善后能力不足导致后续预防堪忧的情况。应构建三级预防模型,在初级预防阶段进行宣传教育,使已然受害人和潜在受害人经历“渗透—共鸣—内省—发散”的反诈宣传教育过程;在次级预防阶段由公安机关预警劝阻,突破反诈技术,优化劝阻方案,加强对被害人的后续监督;在三级预防阶段追赃挽损,拓宽救助渠道,对被害人进行心理疏导、重建,注重后续跟踪调查,丰富电信网络诈骗被害预防经验,优化被害预防方案。In the face of telecom network fraud crime,we should build a new governance model specifically targeting victims’vulnerability,with victimization prevention as the core approach.At present,China’s victimization prevention efforts are confronted with several challenges:publicity and education are mere formalities,leading to reduced effectiveness,early warning and intervention measures lack strength,resulting in a low success rate,and after-care capabilities are insufficient,causing concerns about subsequent prevention.To address these issues,a three-tier prevention model should be established.In the primary prevention stage,publicity and education should be conducted to ensure that both current victims and potential victims undergo an anti-fraud educational process involving“penetration,resonation,introspection,and divergence”.In the secondary prevention stage,the public security organs should issue warnings and provide dissuasion,break through the anti-fraud technological barriers,optimize the dissuasion plans,and strengthen the follow-up supervision of the victims.In the tertiary prevention stage,efforts should focus on recovering stolen assets and compensating for losses,broadening rescue channels,providing psychological counseling and rehabilitation for victims,paying attention to follow-up investigations,enriching the experience in telecom network fraud victim prevention,and optimizing the victim prevention programs.
