侦查监督与协作配合办公室的实质化运行研究

摘　　要：侦查监督与协作配合办公室是构建面向审判的检警关系的重要抓手。侦查监督与协作配合办公室在凝聚检警共识、促进“简案快审”、疑难案件协同等方面发挥了积极作用。而实践中,侦查监督与协作配合办公室运行在理念传导、配合衔接、监督效果、工作保障、信息共享以及数据应用等方面存在一定问题,影响了其实质化运行,限制了新型检警关系建构。为此,应依托侦查监督与协作配合办公室传导审判要求和标准、凝聚检警办案共识;完善监督范围、考核指标、联席会议等配套机制;丰富工作方式,加强人员保障;不断拓展检警信息共享的范围和深度,强化数字检察模型研发和应用的数据安全保障,优化数字检察改革,促进侦查监督与协作配合办公室的实质化运行。The investigation supervision and cooperation office is vital to build the trial-oriented relationship between prosecutors and the police.It plays a positive role in gathering the consensus of both parties,encouraging the“quick trial of simple cases”,and coordinating the work in difficult cases.However,in operation of the office,there are some problems as to concept recognition,coordination,the effect of supervision,work support,information sharing and data application,affecting substantive operation of the office,even the construction of newly-typed relationship between prosecutors and the police.Thus,the office of investigation supervision and cooperation should release trial requirements and criteria,and consolidate the consensus.It should establish the relevant mechanism of supervision,assessment indicators and jointly meeting.It should diversify working methods and strengthen the personnel guarantee.It should continuously expand the scope and depth of information sharing,strengthen the data security of digital prosecution model in its research and application,optimize the reform of digital prosecution,and promote the substantive operation.
