摘　　要：为拓宽中医药保护的对象与范畴,我国正在积极探索制定《中医药传统知识保护条例》,该条例的征求意见稿已发布,标志着我国在中医药传统知识保护领域迈出了重要一步。推动中医药传统知识保护立法出台并发挥实效,不仅是对中医药文化遗产的尊重与传承,也是应对全球化背景下中医药传统知识剽窃与滥用风险的重要举措。因此,需要针对《中医药传统知识保护条例(征求意见稿)》存在的问题进行解析,并借鉴域外医药传统知识保护方面的立法经验,提出切实可行的优化建议。In order to broaden the object and scope of the protection of Chinese medicine,China is actively exploring the formula⁃tion of the Regulations on the Protection of Traditional Knowledge of Chinese Medicine,the draft of which has been released for public comment,marking an important step forward in the protection of traditional knowledge of Chinese medicine.Promoting the introduction and effectiveness of legislation on the protection of traditional knowledge of Chinese medicine is not only a sign of respect for and inheri⁃tance of the cultural heritage of Chinese medicine,but also an important measure to address the risk of plagiarism and abuse of tradi⁃tional knowledge of Chinese medicine in the context of globalisation.Therefore,it is necessary to analyse the problems of the Regulation on the Protection of Traditional Knowledge of Traditional Chinese Medicine(Draft for Public Comments)and make practical suggestions for optimisation by drawing on the legislative experience of other jurisdictions in the protection of traditional knowledge of traditional Chinese medicine.
