检察官在办理“熟人”强奸案件中对言词证据的审查与判断路径研究

摘　　要：强奸犯罪严重侵犯女性的性自主权利,特别是一些“熟人”强奸案件中,由于被告人和被害人相识,被告人能够在较为隐蔽的空间接近被害人,致使作案过程缺少目击证人和监控录像直接证实案发经过。被害人报警后,因当事人双方对案件经过的陈述各执一词,造成检察官在审查判断言词证据和认定案件事实上产生困难。在检察机关“高质效办好每一个案件”的新时代价值理念引领下,坚持“三个善于”,立足办案实践,检察官应更新办案思维,采取“横向+纵向”的言词证据审查方法,综合有限的间接证据,对言词证据去伪存真,消除言词证据疑点,完善言词证据内在逻辑,正确认定熟人强奸的案件事实,确保司法公正和法律的正确实施。Rape crimes seriously violate women's sexual autonomy rights.Especially in some"acquaintance"rape cases,due to the acquaintance between the defendant and the victim,the defendant can approach the victim in a relatively concealed space,resulting in a lack of eyewitnesses and surveillance footage to directly confirm the incident process.After the victim reports to the police,the differing statements of the parties about the incident make it difficult for prosecutors to review and judge verbal evidence and determine the facts of the case.Guided by the new era value concept of"handling every case with high quality and efficiency"in procuratorial organs,to ensure judicial fairness and the correct implementation of the law,prosecutors should adhere to the"three abilities"(being adept at studying,communicating,and summarizing),base themselves on case-handling practice,update their case-handling mindset,adopt a"horizontal+vertical"review method for verbal evidence,synthesize limited indirect evidence,authenticate verbal evidence,eliminate doubts in verbal evidence,improve the internal logic of verbal evidence,and correctly ascertain the facts of acquaintance rape cases.
