摘　　要：与智慧司法备受关注不同,智慧立法似乎容易诱发立法者智慧的怠惰而遭遇冷潮。当前智慧立法与立法者智慧的良性互动,是中国式法治现代化的必然要求。智慧立法与立法者智慧的基本问题是立法者主观能动性、科学立法、民主立法和依法立法。过度依赖智慧立法会引发技术依赖、原则困境、表面科学性、形式民主性、初级融贯性等问题。为此,在本体论上,应当明晰立法者智慧是一种实践理性的集体智慧,更好发挥立法者的主观能动性;在方法论上,应当运用立法者智慧在科学立法中的知识论资源,在民主立法中的慎思明辨作用,在依法立法中的整全融贯功能。此外,智慧立法能使真实立法者克服现实的物理学力量鸿沟,助力形成“唯一正解”的立法诠释。Unlike the widespread attention paid to intelligent justice,intelligent legislation seems to easily trigger the intellectual laziness of legislators and encounter a cold reception.Currently,the positive interaction between intelligent legislation and legislators'wisdom is an inevitable requirement for the modernization of the Chinesestyle rule of law.The basic issues of intelligent legislation and legislators'wisdom are the subjective initiative of legislators,scientific legislation,democratic legislation,and legislation in accordance with the law.Excessive reliance on intelligent legislation may lead to problems such as technological dependence,principle dilemmas,superficial scientificity,superficial democracy,and initial coherence.Therefore,in terms of ontology,it should be clarified that the wisdom of legislators is a collective wisdom of practical rationality,and the subjective initiative of legislators should be better utilized;in terms of methodology,the wisdom of legislators should be utilized in the epistemological resources in scientific legislation,the discreet thinking in democratic legislation,and the comprehensive integration in legal legislation.In addition,intelligent legislation can help real legislators overcome the physic power gap in reality and help form a"unique and correct"legislative interpretation.
