摘 要:在绿色低碳转型背景下,2030年实现碳达峰,2060年实现碳中和是中国应对气候变化,贯彻生态文明理念的应有之举。“双碳”目标涉及生态环境公共利益,具备公共属性,以环境公益诉讼制度促进“双碳”目标的实现具有合理性和必要性。应当坚持在国家环境保护义务和人与自然和谐共生理念基础上,厘清环境公益诉讼制度的主体资格、确定合理的环境公益诉讼模式,并进一步探索环境公益诉讼和私益诉讼的有限合并,以此推进“双碳”目标下环境公益诉讼制度的规范化。In the context of the green and low-carbon transformation,achieving carbon peak by 2030 and carbon neutrality by 2060 is a necessary step for China to address climate change and implement the concept of ecological civilization.The “Peak Carbon and Carbon Neutrality” Goals involve the public interest in the ecological environment and possess a public nature.Promoting the realization of the “Peak Carbon and Carbon Neutrality” Goals through the environmental public interest litigation system is reasonable and necessary.We should adhere to the foundation of national environmental protection obligations and the concept of harmonious coexistence between humans and nature,clarify the qualifications of suitable subjects in the environmental public interest litigation system,determine a reasonable environmental public interest litigation model,and further explore the limited integration of environmental public interest litigation and private interest litigation to standardize the environmental public interest litigation system under the “Peak Carbon and Carbon Neutrality” Goals.
