摘　　要：随着信息技术的智能化精进,智能算法逐步应用于包括解决人类娱乐问题在内的诸多领域。网络游戏沉迷问题在智能算法对社会生活的量级影响变化下,也进一步向更多娱乐内容、更广人员范围扩散。以具身理论对游戏关系的生存、娱乐与资本的脉络进行深入分析,可以发现,尽管数字时代人的身心的完全数字化契合了资本增值的逻辑,尽管已有立法和行政措施对未成年人网络游戏沉迷进行了治理,但问题并非限于此。现有规制机制仍面临算法知识鸿沟和监管罅隙的挑战,个人亦被蒙蔽于自主沉沦的论调中,运行在算法基础上的网络游戏沉迷机制对普遍个体与社会造成的侵害日益加剧。针对横亘于立法机关、执法部门与市场主体间的问题,互联网算法管理规定触发的整体算法监管已成趋势。为应对网络游戏沉迷算法对个人权益、家庭关系及社会秩序造成的持续性影响,要着眼于充分激发权利、权力与能力的系统法治思维,依托网瘾侵权损害责任的构建,以公益诉讼机制弥补个体认知缺陷,并以算法行政能力的规范提升来填补监管罅隙。With the advancement of intelligent information technology,smart algorithms are increasingly applied across various domains,including addressing human entertainment issues.The problem of gaming addiction has spread to a broader range of entertainment content and a wider audience,exacerbated by the substantial impact of algorithms on social life.A deep analysis of the relationship among existence,entertainment,and capital through the lens of embodied theory reveals that while the complete digitization of individuals in the digital age aligns with the logic of capital appreciation,existing legislative and administrative measures targeting minors’gaming addiction are insufficient.The regulatory mechanisms face challenges such as the knowledge gap surrounding algorithms and oversight gaps,while individuals often find themselves trapped in narratives of voluntary indulgence.The mechanisms of gaming addiction,powered by algorithms,increasingly harm individuals and society at large.In response to the issues spanning legislative bodies,enforcement agencies,and market entities,the trend towards comprehensive algorithmic regulation triggered by internet algorithm management regulations is emerging.To address the sustained impact of gaming addiction algorithms on personal rights,family relationships,and social order,it is crucial to adopt a systematic legal mindset that fully activates rights,powers,and capacities.This includes establishing liability for internet addiction infringements through public interest litigation mechanisms to remedy individual cognitive deficiencies,and enhancing algorithmic administrative capabilities to bridge regulatory gaps.
