摘　　要：借名购房存在借名人、出名人、相对人三方主体,确定房屋所有权归属涉及三方利益平衡。欲明确借名购房中的物权变动与归属,前提在于精准厘定房屋买卖合同双方当事人。依据不同解释路径,虽然买受人的确定存在多种阐释可能,但原则上将之界定为出名人,无疑将使所有权转移为最贴合《中华人民共和国民法典》的现有物权变动规则。在明晰借名人的法律地位时,须严格贯彻不动产登记簿的外观主义,摒弃所谓事实物权、物权期待权理论。在处理涉及借名人的保护问题时,应综合考虑借名人的生存权利等其他相关价值因素,并将这些因素在执行异议之诉程序中作为特殊情况进行综合考量。In borrowing a name to purchase a house,there are three parties involved:the borrower,the name-holder,and the counterparty.Determining the ownership of the property involves balancing the interests of the three parties.To clarify the changes and ownership of property rights in borrowing a name for housing purchases,it is essential to accurately define the parties involved in the house sale contract.Based on different interpretative paths,while there are various possibilities for determining the buyer,in principle,defining the buyer as the name-holder will undoubtedly transfer ownership in a manner that aligns most closely with the existing rules for changes in property rights under the Civil Code of the People’s Republic of China.When clarifying the legal status of the borrower,it is necessary to strictly implement the principle of appearance in the real estate registration system,rejecting the so-called theories of factual property rights and expectations of property rights.When dealing with the protection of the borrower’s rights,it is important to comprehensively consider their right to survival and other relevant value factors,and to weigh these factors as exceptional circumstances in the execution of objection procedures.
