摘 要:刑事和解制度在适用过程中暴露出被“滥用”“替用”和“弃用”等困境,其主要原因是制度依托的理念比较抽象、特有的价值未能彰显、施行的规则过于粗疏。刑事和解制度能够保障合意的自愿性和规范性,满足基层社会治理的现实需要,补足认罪认罚从宽制度的合理性短板,其价值需要重新审视。应当借助《中华人民共和国刑事诉讼法》第四次修订的契机,将刑事和解制度从特别程序调整到普通程序,并借用认罪认罚从宽制度的平台,将刑事和解制度作为认罪认罚从宽制度的补充。为此,需要从扩大适用范围、丰富参与主体、优化和解方式和疏通救济渠道4个方面对刑事和解制度加以完善,充分体现制度价值。In the process of applying criminal reconciliation, many difficulties occur, such as the abuse of criminal reconciliation, the substitution of alternatives, and the abandonment of criminal reconciliation. All those arise because the concept of the criminal reconciliation system is abstract, the unique value is not manifested, and the implementation of rules is too rough. Criminal reconciliation can ensure the voluntariness and standardization of agreement, meet the realistic need of primary-level social governance, and make up for the shortcoming of the rationality of the plea of guilty and leniency of punishment system, so the values of this system should be re-examined. Accordingly, the fourth revision of the Criminal Procedure Law of the People's Republic of China should be utilized as a historic opportunity to put criminal reconciliation system from the special procedure to the ordinary procedure, and set criminal reconciliation system up as an important supplement for the plea of guilty and leniency of punishment system with the latter's platform. To this end, improvements must be made in four aspects to give full play to its functions, including expanding the scope of application, enriching the participating subjects, optimizing the means of reconciliation and facilitating redress measurements.
