骗取贷款罪的限缩适用研究

摘　　要：《刑法修正案(十一)》删去骗取贷款罪中“其他严重情节”的规定,新修订的《关于公安机关管辖的刑事案件立案追诉标准的规定(二)》将“重大损失”明确为“直接经济损失”,这些都体现出国家要限缩适用本罪的趋势。理论界关于保护法益、欺骗手段、重大损失等问题一直存在很多不同观点,实践中也因为对这些要件的认定不明确,将一些不构成犯罪的行为定罪。所以要立足保护法益,严格认定各构成要件。首先,将保护法益限定为信贷资金安全;其次,“欺骗行为”的认定要注意因果关系,放款人没有受到欺骗的情形就不符合本罪,而且骗取小额贷款公司贷款的行为也应当排除;最后,重大损失在立案侦查时确定才合理,如果有足额担保也不应当认为给金融机构造成重大损失。The "Criminal Law Amendment (XI)" has removed the provision of "other serious circumstances" in the crime of obtaining loans by fraud,and the newly revised "Regulations on the Standards for Filing and Prosecution of Criminal Cases under the Jurisdiction of Public Security Organs (II)" clarifies "significant losses" as "direct economic losses." These changes reflect a national trend towards restricting the application of this crime.The theoretical community has long held diverse views on issues such as the protected legal interests,deceptive means,and significant losses.In practice,due to the unclear identification of these elements,some behaviors that do not constitute crimes have been convicted.Therefore,it is necessary to base the protection of legal interests and strictly identify the constituent elements.Firstly,the protected legal interests should be limited to the security of credit funds.Secondly,in identifying "deceptive acts," attention should be paid to causality,and situations where the lender has not been deceived do not meet the criteria,and acts of obtaining loans from small loan companies by fraud should also be excluded.Finally,it is reasonable to determine significant losses during the filing and investigation process,and if there is sufficient collateral,it should not be considered as causing significant losses to financial institutions.
