立公与弃私:论慎到政治伦理思想的内在向度

摘　　要：慎到政治伦理观具有明显的黄老道家的底色。在承继老子治道思想的基础上,他吸收了法家、儒家等学派的治理主张,熔铸出新,构建体用兼备的治世学说,将公作为其政治主张的价值基点。在理论依据方面,慎到阐发了道的绝对性与至上性,认为大道无偏无私。因此,他指出施政者应效法大道,公而无私,实施与道相契合的政治措施。在制度构建方面,慎到强调以制度化的君臣共治模式来代替具有人治色彩的君主独治模式,借以规制行政主体利用制度的漏洞做出背公谋私的行为。在政治行为方面,慎到主张君臣共守法度、克己奉公,按照法度来践行各自所承担的职责。慎到的政治伦理思想为此后黄老道家阐发治理观点奠定了话语基础与致思路径,其理论中所蕴含的贵法、尚公等观点主张经过创造性转化也能为当前法治社会建设提供经验借鉴。Shen Dao's political ethical views are distinctly grounded in the Huang-Lao Daoist tradition.On the basis of inheriting Laozi's governance ideas,he assimilated the governance ideas of Legalism,Confucianism and other schools,forging a new synthesis and constructing a comprehensive theory of governance that takes the public as the value cornerstone of his political propositions.In terms of theoretical foundation,Shen Dao expounded on the absoluteness and supremacy of the Dao,believing that the Great Dao is impartial and selfless.Therefore,Therefore,he argued that policymakers should emulate the Dao,acting selflessly and implementing political measures that align with the Dao.In terms of institutional construction,Shen Dao emphasized replacing the autocratic model of monarchical rule with a systematized model of shared governance between ruler and ministers,thereby regulating administrative subjects from exploiting loopholes in the system to act against the public interest for personal gain.In terms of political behavior,Shen Dao advocated that both ruler and ministers adhere to the law and serve the public interest,fulfilling their respective responsibilities in accordance with the law.Shen Dao's political ethical thought laid the discursive foundation and thought-provoking path for subsequent Huang-Lao Daoist elaborations on governance,and the pro-law,pro-public propositions contained in his theory,through creative transformation,can also provide experiential reference for the current construction of a rule-of-law society.
