摘　　要：党和国家为实现就业公平做出了巨大努力,但就业中对女性的性别歧视仍然存在。实践中,法律条款的细化仍显不足,导致部分保护性条款被片面解读;司法裁判的执行也面临一定的挑战,影响了法律的有效实施。为避免性别歧视对经济增长和人口结构产生负面影响,治理应遵循淡化性别差异,强化性别平等的基本原则。在事前预防方面,应针对不同形式的歧视设立明确标准,增强法律的可操作性,扩大责任形式和物质赔偿力度,提升法律威慑力。在事后规制方面,可根据就业阶段细化案由,推行举证责任倒置制度,并引入公益诉讼机制,以提高女性维权的实效性。通过立法、司法、社会文化建设等多方联动,全面根治就业性别歧视,保持我国人力资源的禀赋优势,助力应对当前世界百年未有之大变局。Despite the significant efforts made by the Party and the government to ensure fair employment,gender discrimination in employment still persists.In practice,legal provisions lack sufficient detail,leading to a one-sided interpretation of protective clauses.At the same time,the enforcement of judicial rulings faces certain challenges,affecting the effective implementation of the law.To avoid the negative impact of gender discrimination on economic growth and population structure,governance should follow the principle of de-emphasizing gender differences and reinforcing gender equality.In terms of prevention,clear standards should be established for different forms of discrimination,enhancing the enforceability of the law.Additionally,the scope of liability and material compensation should be expanded to increase the law’s deterrent effect.In terms of post-regulation,causes of action should be refined based on employment stages,the system of reversed burden of proof should be implemented,and public interest litigation should be introduced to improve the effectiveness of women’s rights protection.By combining legislative,judicial,and socio-cultural measures,a comprehensive solution to employment gender discrimination can be achieved,helping to maintain China’s advantage in human resources and respond to the unprecedented global changes of the current era.
