受虐妇女杀夫案件的出罪路径分析

摘　　要：司法实践中,非对峙性的受虐妇女杀夫案往往以故意杀人罪定罪处罚,没有适用出罪事由实现无罪的可能性。针对该问题,我国刑法学界对该类案件中的各类出罪路径进行探索,传统的正当防卫理论由于缺乏“正在进行”的时间条件和限度条件而难以普遍适用,作为免责事由的“受虐妇女综合症”理论和期待可能性由于无法阻却违法,存在正当防卫以及共犯可罚的理论困境和问题。而防御性紧急避险理论作为出罪路径具有较强的可行性。受虐妇女基于生命权冲突的利益衡量,为保护自己的生命健康权益免受丈夫的暴力行为避免遭受家暴,在穷尽其他救助手段后,不得已选择反杀行为具有出罪的正当性。In judicial practice,non-confrontational battered women who kill their husbands are often convicted and punished for the crime of intentional homicide,without the possibility of applying exculpation to achieve innocence.In order to address this problem,China’s criminal law academia to explore the various types of crime path in this type of case,the traditional theory of self-defense due to the lack of“in progress”time conditions and limitations of the conditions and difficult to apply universally,as a cause of exoneration of the“battered woman syndrome”theory and expectancy of possibility due to the inability to block the possibility of the“battered woman syndrome”theory and expectancy of possibility.The theory of“battered women’s syndrome”as a cause of exemption and the theory of expectancy of possibility are not able to prevent the violation of the law,and there are theoretical dilemmas and problems of justifiable self-defense as well as the punishability of complicity.And the defensive emergency avoidance theory has a strong feasibility as a path to exoneration.Based on the conflict of interest of the right to life,in order to protect her life and health rights from her husband’s violence and avoid domestic violence,the battered woman has no choice but to choose the anti-killing behavior after exhausting other means of help,which has the legitimacy of the crime.
