检察机关参与专门学校法治教育的路径研究

摘　　要：加强检察机关与专门学校的衔接,对提升专门学校教育矫治效果意义重大。检察机关充分发挥开展法治教育和犯罪预防工作的资源优势,在法治教育、教育矫治、管护救助等方面开展合作,无疑是检察机关与专门学校衔接机制中的重要内容。尤其在检察机关参与专门学校法治教育方面,将进一步促进二者的有效衔接。检察机关参与专门学校法治教育具备来自国家亲权主义、最有利于未成年人原则、检察机关法律监督职能定位以及推动社会治理等方面的法理基础,但目前仍然面临着参与程序不清晰、评价标准不统一、收治工作存瓶颈、个性施教有欠缺等各类问题,因此应当加强相关法律规范的实施、促进教育与检察融合、健全配套设施建设,并积极引入社会力量支持。Strengthening the connection between procuratorial authorities and specialised schools is of great significance to improving the educational correctional effect of specialised schools and ensuring the legal supervision function of procuratorial authorities.The procuratorial authoritiesfully utilize their resource advantages in carrying out rule-of-law education,andcrime prevention,as well ascooperate in rule-of-law education,correctional education,and protective assistance.There is no doubt that rule-of-law education is asignificantaspectof the connection mechanism betweenprocuratorial authorities and specialised schools.The participation of procuratorial authorities in the rule-of-law education in specialised schools will further enhance the effective connection between them.The involvement of procuratorial authorities in providing rule-of-law educationto special schools has a legal basis from state pro-rightsm,the principle of maximizing minors′interests,the positioning of the legal supervision functions byprocuratorialauthorities,andrepresents a new path for in social governance.However,currently,there are various problems faced by procuratorial authoritiesparticipating in the rule-of-law education such as unclear legal process,and lack of personalisededucational approaches..Therefore,we should improve the construction and implementation of relevant legal normswhile promoting integration between educational institutions and prosecutorial bodies;additionally strengtheningsupporting facilities;actively introducing the support of social forces.
