检察民事公益诉讼中支持起诉制度的适用问题

摘　　要：近年来,随着检察机关提起公益诉讼实践的开展,支持起诉制度逐渐发挥作用。检察机关通过支持起诉敦促适格主体行使公益诉权,不仅有利于理顺诉权顺位,还能推动多元主体为维护公共利益协同发力。然而,从司法实践看,虽然检察机关支持起诉案件的数量逐年增加,但支持起诉的案例总体占比不高,且支持起诉的方式混乱,检察机关与适格主体在支持起诉中联动性不强等问题依然突出。上述问题,与检察机关遵循的支持起诉法律依据有缺陷、支持起诉制度适用条件规则缺失,以及检察机关角色定位模糊等因素密切相关。因此,应当立法界定检察机关“支持起诉人”的身份并允许其介入诉前阶段,健全检察机关支持起诉的条件规则,明确检察机关介入诉讼的限度,以推动支持起诉制度在检察民事公益诉讼中的良性运行。With the development of the pilot practice of procuratorial organs initiating public interest litigation,the system of supporting prosecution has gradually come into play in recent years.By supporting prosecution,procuratorial organs urge qualified entities to exercise their public interest litigation rights,straighten out the order of litigation rights,and also promote the coordination of multiple entities to make efforts to safeguard the public interest.However,from a practical point of view,although the number of pro-prosecution is increasing year by year,the rate of pro-prosecution is not high,the methods of supporting prosecuting are chaotic,and the linkage of qualified subjects is not as expected,which is closely related to factors such as the defects of legal basis,the lack of applicable conditions and rules,and the ambiguity of role positioning.Therefore,procuratorial organs should be given the status of“pro-prosecution”to allow intervention in the pre-litigation stage,improve the rules of conditions,and clarify the limits of support for prosecution,so as to promote the good operation of the system of supporting prosecution in procuratorial public interest litigation.
