摘 要:生态环境领域行刑衔接机制不畅是环境治理现代化道路上所必须直面的命题。生态环境领域行刑衔接目前仍存有实体要素存在争议、移送程序衔接断层、检察机关监督失灵的现实困境,无法有效发挥该衔接机制的效能与作用。本文针对上述问题提出选择适当立法模式、明晰争议实体要素、调适断层衔接程序、完善检察监督制度的纾困思路,以期能够进一步完善我国生态环境领域行刑衔接机制,确保其顺畅运行,回应健全现代环境治理体系的要求,切实提升我国环境治理水平。The poor connection of administrative law and criminal law in the field of ecological environment is a proposition that must be faced on the road of modernization of environmental governance.At present,there are still real dilemmas in the connection of administrative law and criminal law in the field of ecological environment,such as disputes over physical elements,faults in the convergence of transfer procedures,and failures in the supervision of procuratorial organs,so the effectiveness and role of the convergence mechanism cannot be effectively used.In view of the above-mentioned issues,it is necessary to select an appropriate legislative model,clarify the entity elements of the dispute,adjust the fault convergence procedures,and improve the procuratorial supervision system,so as to further promote the connection of administrative law and criminal law in the field of ecological environment in China,and effectively improve the level of environmental governance.
