摘　　要：我国刑事立法兼具自由法治与社会福利的双重特点是我国设定大量行政犯罪名的原因。伴随市场经济的发展,动用刑法管控风险的范围和力度逐步加大,行政犯罪名的激增使得大量空白罪状出现,不断冲击着传统意义上罪刑法定原则并为其带来新的时代内涵与价值。行政犯视域下罪刑法定原则的价值在于法安定的维护与人权的保障,为更好发挥罪刑法定原则的价值,不仅要保证前置法的明确性以满足罪刑法定的形式要求,还要使得行政犯的成立符合整体的法秩序要求,满足罪刑法定原则前置法与刑法法秩序相统一的时代要求。明确并正确选择前置法并对行政犯的犯罪构成做实质解释,使得行政犯出入罪更加合法合理是实现罪刑法定原则坚守的基本路径。The dual characteristics of free-rule law and social welfare in China's criminal legislation are the reasons for the establishment of a large number of administrative offense charges in China.With the development of the market economy,the scope and intensity of using criminal law to control risks have gradually increased.The surge in administrative offense charges has led to the emergence of a large number of open-ended descriptions of offenses,continuously challenging the traditional principle of legality and bringing new connotations and values to it in the new era.The value of the principle of legality in the context of administrative offenses lies in maintaining legal stability and safeguarding human rights.To better leverage the value of the principle of legality,it is necessary not only to ensure the clarity of preliminary laws to meet the formal requirements of legality but also to ensure that the establishment of administrative offenses conforms to the overall legal order and meets the contemporary requirement of unifying preliminary laws with the legal order of criminal law under the principle of legality.Clarifying and correctly selecting preliminary laws and providing substantive interpretations of the criminal constituents of administrative offenses to make the conviction and acquittal of administrative offenses more legal and reasonable are the basic paths to uphold the principle of legality.
