内部监督保障促进检察官正确行使裁量权研究

摘　　要：检察裁量权由检察权派生而来,是检察机关行使检察权的重要方式,也是检察使命得以实现的有效路径,其扩张趋势潜在地影响着刑事司法政策转向、认罪认罚从宽制度施行等诸多方面。因此,优化检察裁量权行使亟需强化内部监督,正确处理好权力配置间的张力关系以及“放权”与“收权”之间的平衡问题。就监督模式而言,域外关于平衡检察一体与检察官的关系处理以及信任和匹配监督的方法运用可为我国提供一定借鉴;就具体路径而言,可自明确权力清单配置、强化内外二维监督协调、优化业绩评估考核模式、落实依法履职免责机制、构建检察裁量权立体监督网络等方面进一步完善和优化我国检察内部监督体系,实现案件质量、办案效率以及责任分工的有机统一。Deriving from procuratorial power,procuratorial discretion is an important way for procuratorial organs to exercise procuratorial power,as well as an effective path for the fulfilment of the procuratorial mission.However,the expansion of procuratorial discretion potentially influences the criminal judicial policy shifts and the implementation of the plea-for-leniency system.Therefore,the exercise of prosecutorial discretion can be optimized by strengthening internal supervision,correctly allocating and balancing power.In terms of the supervision mode,the extraterritorial ways can provide certain insights for China,such as how to balance the relationship between the procuratorial integration and prosecutors,and how to match supervision system;in terms of the specific path,the internal procuratorial supervisory system in China can be further improved and optimized by clarifying the power list,strengthening the coordina-tion of internal and external supervision,optimizing the mode of performance assessment and appraisal,implementing the exemption-from-liability mechanism for duty performance in accordance with the law,and constructing a three-dimensional supervisory network of the prosecutorial discretion,to achieve the organic unity of the high case quality,the efficiency of cases handling and the division of responsibilities.
