数字正义视阈下刑事证据制度的时代变革与本土重塑

摘　　要：在数字技术与刑事司法日益紧密的时代背景下,刑事证据制度呈现出证据形式数字化、证据收集远程化、证据存储链条化、证据审查智能化以及事实认定类案化的特征。数字正义是数字社会刑事司法制度的重要评价标准,在刑事证据制度的数字化变革中,数字正义在提高司法效率、配置司法资源以及提升裁判质量层面获得了价值实现。但同时新技术新应用所导致的证据权利保障失衡化、证据推理过程黑箱化以及证据准入资格宽泛化也阻碍着数字正义的实现。刑事证据制度的数字化变革须在数字司法实践的基础上加以本土重塑,协调好数字变革与证据权利保障的平衡,揭开人工智能算法神秘主义的面纱,规范新型证据严格准入机制,通过数字正义的更好实现促进刑事证据制度的完善。In the context of the increasingly close relationship between digital technology and criminal justice,the criminal evidence system presents the characteristics of digitized evidence forms,remote evidence collection,chain based evidence storage,intelligent evidence review,and case based factual determination.Digital justice is an important evaluation criterion for the criminal justice system in the digital society.In the digital transformation of the criminal evidence system,digital justice has achieved value realization in improving judicial efficiency,allocating judicial resources,and enhancing the quality of judgments.But at the same time,the imbalance of evidence rights protection caused by new technologies and applications,the black box process of evidence reasoning,and the broad qualification of evidence access also hinder the realization of digital justice.The digital transformation of the criminal evidence system needs to be reshaped locally based on digital judicial practice,balancing digital transformation with evidence rights protection,uncovering the veil of artificial intelligence algorithm mysticism,regulating the strict admission mechanism of new evidence,and promoting the improvement of the criminal evidence system through better realization of digital justice.
