涉外民事诉讼中电子送达问题研究

摘　　要：随着互联网技术的发展,电子送达被公众所接受与认可。送达是民事诉讼程序中的重要一环,电子送达具有成本低效率高的优势,能够使得当事人迅速知悉相关的诉讼文书,进而使得当事人的合法权益得到保障。当前,我国涉外民事诉讼中的电子送达具有国内法与国际法上的法律依据,且电子送达也有着传统送达方式无法比拟的长处。但是,其在现实运行中存在着适用规则缺失、没有统一的送达平台以及潜在的安全隐患等问题。而解决这些问题应当从细化相应的规则、提高电子送达的可靠性、构建涉外电子送达平台以及加强国际合作入手。With the development of Internet technology,electronic service is accepted and recognized by the public.Service is an important part of civil proceedings.Electronic service has the advantage of low cost and high efficiency,which can make the parties quickly know the relevant litigation documents,so that the legitimate rights and interests of the parties are protected.At present,electronic service in foreign civil litigation in our country has the legal basis in domestic law and international law,and electronic service also has the advantages that traditional service can not match.However,there are some problems such as the absence of applicable rules,no unified service platform and potential security risks.To solve these problems,we should deal with them from refining the corresponding rules,improving the reliability of electronic service,building foreign-related electronic service platform and strengthening international cooperation.
