摘  要:人工智能的发展推动着产业大规模的升级,给社会经济生活带来深刻变革的同时也挑战了现有的法律制度。人工智能技术的发展带来了劳动主体资格界定、就业歧视以及失业风险增加等诸多问题。面对人工智能带来的理论与实践上的双重挑战,为充分发挥《劳动法》对劳动关系及其它与劳动关系有密切联系的社会关系的调节作用,法学界在立法理论层面应推动劳动主体范围扩张,消除就业歧视,完善法律规制;在实践层面应当加强社会保障建设以促进就业,灵活应对人工智能给现有劳动法律制度带来的冲击与挑战。The development of artificial intelligence has promoted large-scale industrial upgrading,brought profound changes to social and economic life,and challenged the existing legal system.In the process of applying the Labor law,the development of artificial intelligence technology has brought about many problems such as the definition of labor subject qualifications,employment discrimination,and the increase of unemployment risks.In the face of the dual theoretical and practical challenges brought by artificial intelligence,in order to give full play to the regulatory role of the Labor Law on labor relations and other social relations closely related to labor relations,it is necessary to promote the expansion of the scope of labor subjects and improve the legal regulation of employment discrimination at the legislative theoretical level,and strengthen social security at the practical level to promote employment and flexibly respond to the impacts and challenges brought by artificial intelligence to the existing labor legal system.
