摘  要:相比于传统司法诉讼,区块链电子存证具有低成本、高效率和可靠性强的特点。尤其关于区块链电子存证溯源机制的认定,对于第三方司法存证平台区块链技术存证的大力推广具有重要的推动作用。目前区块链第三方司法存证平台机构还存在监管机制不够规范、溯源机制不够完善、部门协同机制不够畅通等问题。为此,司法机关亟须加强事前审查、建立溯源规则、加强跨部门协同等规范性指引,确保取证结果的准确性、可靠性和有效性。这也是我国法院推进审判体系现代化,优化法院机构职能体系,重点解决好机构设置规范、职能行使协同、体系运行高效等问题的重要理论实践。Compared with traditional judicial proceedings,electronic evidence preservation on blockchain is characteristic of low cost,high efficiency and reliability.Especially,the recognition of the traceability mechanism of blockchain electronic evidence preservation plays a significant role in promoting the wide adoption of blockchain technology for evidence preservation by third-party judicial evidence preservation platforms.At present,there are still issues with blockchain-based third-party judicial evidence preservation platforms,such as the nonstandard regulatory mechanism,the imperfect traceability mechanism,and the impeded cross-departmental coordination mechanism.To address this,judicial authorities urgently need to strengthen pre-event reviews,establish traceability rules,and enhance cross-departmental coordination and other normative guidelines to ensure the accuracy,reliability,and validity of evidence collection results.This is also an important theoretical practice for China’s courts to advance the modernization of the judicial system,optimize the functional system of court institutions,and focus on solving issues such as standardized organizational setup,coordinated exercise of functions,and efficient system operation.
