摘 要:非急救转运是解决非急救需求挤占急救转运资源、转运资源不均衡等问题的有效措施。综合运用风险管理理论、法律责任视角以及医疗法规与政策框架分析当前我国非急救转运实践中的主要问题,发现社会主体参与非急救转运存在非法经营、医疗过错与医疗事故、合同违约、隐私泄露、交通违法行为以及不当宣传与欺诈等方面法律风险,导致非急救转运服务市场规模发展受限。对此,社会主体应当加强内部管理,提升服务质量,遵守相关法律法规和行业标准,并与政府部门、行业协会等保持良好沟通与合作。同时,社会主体还应当注重自身品牌建设,提升消费者信任度和满意度。Non-emergency transport is an ideal governance tool for effectively addressing issues such as the crowding out of emergency transport capacity by non-emergency demand and the unbalanced distribution of transport resources.Utilizing the theories and frameworks of risk management,legal responsibility,and medical regulations and policies to analyze and discuss the main challenges in the current practice of non-emergency transport in China,this study highlights that the participation of social actors in non-emergency transport is subject to legal risks,including illegal operation,medical negligence and malpractice,contractual breaches,privacy violations,traffic offenses,and misleading advertising and fraud.These risks limit the development of the non-emergency transport service market.Social actors should strengthen internal management,improve service quality,comply with relevant laws and regulations,and adhere to industry standards,while also maintaining effective communication and cooperation with government departments and industry associations.Additionally,social entities should focus on brand building to enhance consumer trust and satisfaction.
