摘　　要：中华民族共同体建设背景下,中华优秀传统文化成为中国式现代化进程的核心竞争力,但当前中华优秀传统文化利益机制缺失,难以纳入西方主导的知识产权制度,这不利于中华民族共同体建设。经过探索发现,基于马克思主义劳动价值论论证中华优秀传统文化属于财产,基于洛克劳动财产论论证中华优秀传统文化应当赋予产权,中华优秀传统文化可以纳入财产权客体。中华优秀传统文化保护符合知识产权制度的本义,知识产权制度不应局限于“知识创新”也应注重“知识传承”,扩张知识产权制度保护中华优秀传统文化有利于中国参与全球知识产权博弈,应创设新型知识产权——传统文化产权。传统文化产权作为一种新型知识产权,是权利人依法对特定传统文化所享有的直接支配和排他的权利,主体为特定地区的集体劳动群众,客体为具有传承性、认同性和价值性的传统文化,权利内容包括控制权、使用权和收益权。传统文化产权保护体系的构建,应确立传统文化产权永久保护规则、集体保护规则和区域保护规则。Excellent traditional Chinese culture constitutes the spiritual lifeblood of the Chinese nation,with its extensive historical accumulation and origins forming a cornerstone for forging a strong sense of community for the Chinese nation.Considered a precious asset of the Chinese nation,excellent traditional Chinese culture should be safeguarded.Moreover,as it is founded on culturally significant wealth,this study believes it will contribute to nurturing a solid material foundation for modernization.Findings also illustrate that in the context of building the community for the Chinese nation,excellent traditional Chinese culture has emerged as a pivotal competitive advantage in the pursuit of Chinese-style modernization.However,it currently appears to be facing challenges such as a lack of incentive mechanism or incompatibility with Western intellectual property(IP)rights frameworks,which seem to hinder the construction of the Chinese national community.Culture,functioning as a socioeconomic development factor,does not inherently generate commodity value but potentially enhances labor's capacity to create wealth.Utilizing Marxist labor theory of value,it can be argued that traditional Chinese culture merits classification as property.Furthermore,it can also be said that granting property rights to excellent traditional Chinese culture meets both the positive and negative requirements of John Locke's labor theory of property,thereby validating the assignment of such rights.By recognizing excellent traditional Chinese culture as an object of property rights,a theoretical foundation is established for its protection under the IP system.In addition,both newly innovated knowledge and long-standing traditional knowledge,being a crystallization of human wisdom,should be protected by the IP system.In fact,preserving high traditional Chinese culture aligns with the original intention of the intellectual property system.The existing IP system falls short of adequately protecting high traditional Chinese culture,necessitating
