数字技术赋能综合行政执法改革中的部门协作路径探究

摘　　要：自1996年《中华人民共和国行政处罚法》颁布以来,我国综合行政执法改革经历了从相对集中行政处罚权到多领域跨部门综合行政执法的演变。当前,综合行政执法部门和各业务主管部门之间的协作困难是改革面临的突出问题,亟须借助数字技术的支持与赋能,以完善部门协作关系。在综合行政执法改革中,对传统行政执法路径的依赖、存在数据壁垒、部门间权责不一致、数字技术运用不足等问题凸显,制约了部门协作的进一步发展。对此,文章提出以“数字治理”理论助推部门协作关系建设,通过加快数据共享标准统一、优化协同工作机制、加强资源支持与技术运用,优化综合行政执法部门和各业务主管部门之间的协作路径,以更好地实现国家治理体系和治理能力现代化的目标。Since the promulgation of the Administrative Penalty Law of the People's Republic of China in 1996,China's comprehensive administrative law enforcement reform has undergone an evolution from relatively centralized administrative penalty power to comprehensive administrative law enforcement across multiple fields and departments.Currently,the difficulty in cooperation between comprehensive administrative law enforcement departments and various business supervisory departments is a prominent issue faced by reform,and it is urgent to rely on the support and empowerment of digital technology to improve departmental cooperation relationships.In the comprehensive administrative law enforcement reform,problems such as dependence on traditional administrative law enforcement paths,the existence of data barriers,inconsistent responsibilities among departments,and insufficient use of digital technology have become prominent,which have constrained the further development of departmental cooperation.In this regard,the article proposes to use the theory of"digital governance"to promote the construction of departmental collaboration relationships,by accelerating the unification of data sharing standards,optimizing collaborative work mechanisms,strengthening resource support and technology application,optimizing the collaboration path between comprehensive administrative law enforcement departments and various business supervisory departments,in order to better achieve the goal of modernizing the national governance system and governance capacity.
