摘　　要：研究目的:基于发展权转移和分配正义理论,探索区域之间耕地保护损益关系评估和补偿框架制定,为国家建立耕地保护补偿制度提供参考。研究方法:借助资本资产定价和随机森林等模型,构建土地发展权价值损失测度体系及区域间耕地保护补偿框架,并以长江中下游地区为案例区进行实证分析。研究结果:(1)土地发展权配置差异引发的区域损益关系清晰可度量,能有效解决因用途管制限制耕地开发建设而产生的补偿支付和增值回收问题,是开展耕地保护补偿的重要媒介;(2)分配正义思想与“保护者受偿、受益者补偿”的原则高度契合,可用于搭建区域间耕地保护补偿的理论框架,该框架包括耕地价值评估、补偿分区划分、适度补偿标准确定等。(3)根据耕地盈亏状况,确定上海市等35个补偿区、阜阳市等31个受偿区和岳阳市等17个平衡区,补偿额度介于220.70万~451051.04万元/a,受偿额度介于4328.75万~231525.91万元/a。研究结论:横向耕地保护补偿以土地发展权价值损失为媒介串联区域之间的损益与补偿关系,追求分配正义的价值导向,注重耕地有效保护与区域协调发展的内在统一性。The purposes of this are to assess the interregional benefit-loss relationships and develop a compensation framework for cultivated land protection,based on the theories of land development rights transfer and distributive justice,providing a reference for establishing a national cultivated land protection compensation system.The research methods are as follows.The study constructs a framework for measuring the value loss of land development rights and an interregional compensation system for cultivated land protection,and conducts an empirical analysis by using the Capital Asset Pricing Model(CAPM)and Random Forest and taking the Middle and Lower Reaches of the Yangtze River as a study area.The research results show that:1)the disparities in the allocation of land development rights result in measurable interregional benefit-loss relationships,which can effectively address issues related to compensation payments and value recovery caused by land use regulations that limit cultivated land development.These relationships serve as an important mechanism for implementing compensation in cultivated land protection.2)The principle of distributive justice aligns closely with the compensation philosophy of“beneficiaries compensate,protectors benefit”.This alignment provides a sound theoretical basis for the horizontal compensation framework for cultivated land protection,including land value assessment,the division of compensation zones,and the establishment of appropriate compensation standards.3)In the Middle and Lower Reaches of the Yangtze River,the study identifies 35 payment zones,31 compensation zones and 17 balanced zones.The compensation amounts range from 2.2070 million to 4510.5104 million CNY per year,while the recipient amounts range from 43.2875 million to 2315.2591 million CNY per year.It concludes that horizontal compensation framework for cultivated land protection,which links interregional benefit-loss relationships and compensation through the loss of land development rights value,is guided by the
