摘　　要：如何应对智慧医疗技术革新所带来的社会风险与法律挑战,是数据科技时代背景下建设新时代健康中国的必考题。智慧医疗技术在促进医疗领域数字转型与效能提升的同时,也带来了医疗隐私、医疗人权自主、医疗事故等风险与挑战。因此,我们应肯定医疗隐私数据的价值效益并对其进行保护,完善传统的“过错责任+严格责任+无过错责任”医疗事故问责制,以更好明确智慧医疗参与下人机混合模式的事故责任,应对智慧医疗对自主性以及人权的挑战,并围绕“人权为本明确原则+针对性监管体制+保障救济畅通”三个方面建立健全智慧医疗监管治理框架,在保障法益的同时为智慧医疗发展留足余地,以期推进智慧医疗的良性发展,响应健康中国建设的号召。How to cope with the social risks and legal challenges brought about by the innovation of smart medical technology is a must for the construction of a new era of health China in the context of the era of data and technology.While scientific and technological development brings well-being,it often brings legal problems,and the gap between technological change and legal lag needs to be filled by the law in a gradual manner.Intelligent medical technology realizes digital transformation and efficiency improvement in the medical field,but also brings risks and challenges such as medical privacy,medical malpractice,and human rights autonomy,etc.It is necessary to affirm the value and benefit of medical privacy data and protect it,and improve and modify the traditional“fault liability+strict liability+no-fault liability”medical malpractice accountability system,in order to better It is necessary to clarify the responsibility for accidents in the human-computer hybrid model of smart healthcare participation,recognize the challenges of smart healthcare to autonomy and human rights,and establish a sound framework for the regulation and governance of smart healthcare around the three aspects of“clear principles of human rights-based approach+targeted regulatory system+smooth guarantee and relief”,so as to protect the benefits of the law and at the same time leave room for the development of smart healthcare.It tries to promote the benign development of intelligent medical care and respond to the call for the construction of a healthy China.
