摘　　要：出庭作证是证人的法定义务,刑事证人在线出庭作证制度将证人提供证人证言、接受询问质询这一过程由线下实体法庭转移至线上虚拟法庭中,为证人作证提供了多元化选择。“法庭”这一概念在本质上不应被定义为某个特定的物理场所,而应扩展至法官行使审判权解决纠纷的各种空间。刑事证人出庭作证虽然必须在一定的空间内完成,但也不应局限于某个特定的空间。刑事证人在线出庭作证除与传统出庭作证方式具有同等的协助查清事实、保障被告人质证权等价值外,还具有高效便捷、缓解证人出庭难困境、提升作证安全性等独特价值。在线出庭作证中,由于法官与证人物理间隔较远,需采取一定的方法保证证人出庭作证的环境与秩序。It is the legal obligation of witnesses to testify in court.The system of online testimony for criminal witnesses transfers the process of witnesses providing witness testimony and accepting interrogation from offline physical courts to online virtual ones,providing diversified options for witnesses to testify.The concept of“court”should not be defined as a specific physical place in essence but be extended to various spaces where judges exercise judicial power to resolve disputes.Although criminal witnesses must testify in a certain space,they should not be limited to a specific space.In addition to sharing the same values as traditional in-court testimony,such as assisting in clarifying facts and safeguarding the defendant’s right to cross-examination,online testimony for criminal witnesses also boasts unique values,including efficiency and convenience,easing the difficulty of witness appearance in court,and enhancing the safety of testimony.In online court testimony,due to the significant physical distance between the judge and the witness,certain methods must be adopted to ensure the environment and order of the testimony of the witness.
