摘　　要：《区域全面经济伙伴关系协定》(RCEP)尚未设置专门的环境条款,而仅包含环境例外规定,在环境保护上存在界定模糊、范围狭窄、领域受限等问题。为了适应全球环境治理新要求、顺应环境条款发展新趋势,RCEP应升级环境条款。在参照自由贸易协定环境条款建构逻辑的基础上,RCEP应当朝着内容更加全面、执行效果更好、体现包容性的方向升级,包含环境合作、公众参与、争端解决机制、特定环境问题协调、多边环境公约的遵守以及执行机制等实质性内容。由于RCEP成员的发展水平存在差异,还应循序渐进地推动RCEP环境条款升级,提高环境条款的连通性和联动性。在此过程中,中国应发挥积极作用。The Regional Comprehensive Economic Partnership(RCEP)agreement does not include any special environmental clauses.It only has provisions for environmental"exception"provisions.In terms of environment protection,the RCEP has such problems as vague definition,narrow scope,and field limitations.To align with the evolving requirements of global environmental governance and the contemporary trends in environmental clauses,the RCEP should upgrade its environment-related clauses.On the basis of the construction logic of environmental provisions in reference to free trade agreements,the RCEP should be upgraded in the direction of being more comprehensive in content,better implementation effects,and inclusiveness,including such substantive contents as environmental cooperation,public participation,dispute settlement mechanisms,coordination in specific environmental issues,multilateral environmental agreements,and implementation mechanisms.Given the varying levels of development among RCEP members,the upgrading of the RCEP's environmental provisions should be pushed forward gradually and systematically,the connectivity and interactivity of the environmental provisions should be enhanced,and China's role in the upgrading of the RCEP's environmental provisions should be promoted.
