摘　　要：家法族规是中华法治文明的重要组成部分。传承中华优秀传统法律文化,发掘传统中国家法族规的现代价值,需要深入阐释其治理逻辑。曲阜孔氏家法族规体系是传统中国家族治理的典范文本,包括作为纲领性典章的《孔氏祖训箴规》、外地孔氏族人自订家法族规以及孔氏家族修谱所订条规与行辈。孔氏家法族规体系鲜明地体现了中国古代家族治理重视血缘身份、享有政经特权、家族司法活跃等特色。重视家的价值,以家族为基层社会组成细胞,通过家的联结实现社会团结,厚植家国情怀以巩固精神家园,是传统中国家法族规的核心理念。强调自治解纷,将解纷视作基层治理的核心议题,以家法族规支撑纠纷和平解决,通过家法族规来促进基层善治,是传统中国家法族规的重要功能。作为家内罚则的祭祀罚,在彰显宗法伦理、维护家族稳定等方面集中体现了传统中国家法族规法德共治的运行模式。这些方面的理念、功能和模式,是传统中国家法族规和家族治理迈向现代法治的重要桥梁和纽带。Family discipline and clan regulations are a vital component of Chinese legal culture.Inheriting the excellence of traditional Chinese legal culture and exploring the modern value of traditional family discipline and clan regulations require a deep explanation of their governance logic.The Confucian family discipline and clan regulation system in Qufu serves as a model text of traditional Chinese family governance,including the“Confucian Ancestral Discipline Rules”,self-established clan regulations by Confucian clans in other regions,and rules set forth in Confucian family genealogies.This system distinctly reflects the characteristics of ancient Chinese family governance,such as emphasis on blood relations,enjoyment of political and economic privileges,and active family justice.The core concept of traditional family discipline and clan regulations prioritizes family value,viewing the family as a basic societal unit,achieving social cohesion through familial connections,and nurturing a sense of belonging to both family and state.By emphasizing autonomy and dispute resolution,it supports peaceful resolution of disputes,fostering good governance at the local community level.As a form of family punishment,sacrificial punishment reflects the traditional mode of operation,which combines national law,clan rules,and morality by intertwining the rule of law with the rule of virtue,emphasizing patriarchal ethics and maintaining family stability.The concepts,functions,and models in these areas are important bridges and links for the traditional Chinese family laws and family governance to transition toward modern rule of law.
