西部高校涉外仲裁人才培养目标和培养进路探究

摘　　要：西部地区涉外仲裁事业是国家涉外仲裁事业的“短板”,加大该地区涉外仲裁人才的培养能有效改善此状况。西部高校应立足院校实际和地方需求,从“区际”和“商事”维度出发,培养“区际型涉外商事仲裁人才”;同时,应将人才定位为“涉外商事仲裁服务提供者”,重点培养“涉外仲裁秘书”和“涉外仲裁律师”两类人才。近年来,西部高校涉外法治人才培养实践表明,“涉外仲裁”方向法律硕士和本科涉外法治人才培养实验班是切实可行的培养路径。为更好地推进西部高校“区际型涉外商事仲裁人才”的培养,建议增加“国别仲裁法学”课程,重视“国际商事仲裁模拟仲裁庭辩论赛”的“模拟实践”价值,积极对接外部力量和资源解决实践教学课程师资不足问题。最后,西部高校还应强化“西部高校间”“西部高校与境外高校”以及“西部高校与境外实务部门”三方面的协同发展,创新协同培养机制。Foreign-related arbitration in the western region is the“short board in the barrel”of China’s foreign-related arbitration sector,and increasing the cultivation of foreign-related arbitration talents can effectively improve this situation.Universities in western China should base their efforts on the institutions’actual conditions and local needs,focusing on the“inter-regional”and“commercial”dimensions to strategically position themselves as cultivators of“inter-regional foreign-related commercial arbitration talents.”Simultaneously,they should position these talents as“foreign-related commercial arbitration service providers,”with a focus on cultivating two specific types of talents:“foreign-related arbitration secretaries”and“foreign-related arbitration lawyers.”In recent years,the practice of cultivating foreign-related rule of law talents in universities in western China has shown that it is feasible to establish”foreign-related arbitration”focus within the Master of Laws program,as well as creating pilot classes for foreign-related legal talent cultivation at the undergraduate level.To further enhance the cultivation of“inter-regional foreign-related commercial arbitration talents”in western universities,the teaching curriculum for foreign-related arbitration talents should include“national arbitration law”,attach importance to the“simulated practice”value of the“International Commercial Arbitration Moot”,and actively engage external forces and resources to solve the problem of insufficient teaching staff for practical teaching courses.Finally,universities in western China should enhance and innovate collaborative training mechanisms across three aspects:“collaboration between western universities”,“collaboration between western universities and overseas universities”,and“collaboration between western universities and overseas practical departments”.
