摘 要:海德格尔基于自己的思想任务,把通常表示“正义”的希腊词δ?κη(狄刻)解释为存在之嵌合性发生结构,是存在与存在者之间的生发性接合。这种解释实质上不是一种古典学的实证考究,而是海德格尔由存在历史之思而来,在克服形而上学正义论之际让正义的源始意义显现出来的现象学活动。如此这般被解释的“正义”作为存在自身的发生结构,没有构成伦理学层次上的某种“正义论”,而是构成了任何一种“正义论”在存在论层面上的根据、本质和尺度。作为这样一种尺度,它比伦理学的正义理论更为源始地且更为直接地要求人的特定行为。Based on his task of thinking,Heidegger interprets the Greek term Sikm(dike)which often denotes"justice"as the enjoining and ordering joint-structure of the occurrence of Being,as the joining of Being and beings.In its essence,this interpretation is not the positivist study of the classics,but an act of phenomenologi-cal thinking which is originated from the thinking of the history of Being and reveals the original meaning of justice while overcoming the metaphysical theory of justice,As the occurrence-structure of Being,dike does not constitute a doctrine of"justice"on the level of moral philosophy,but can be designated as the ontological ground,essence and measure of any theory of"justice",As such a measure,Heidegger's dike demands cer-tain kind of human action more originally and directly than any moral theory of justice does.
