摘 要:对外关系法在美国和欧盟已成为一个专门的研究领域,目前在该领域已经有相应的著作、教材出版,国外高校已开设了对外关系法相关课程。在著作内容上,美国对外关系法的内容与欧盟对外关系法的内容存在显著不同。在教学上,对外关系法课程已经纳入欧美多所高校的学位教育课程,讲授者多为具有多学科背景的国际法学者;美国高校对外关系法课程与欧盟国家的对外关系法课程在内容上略有不同,但是在教学目标上较为一致,注重对基础理论知识的把握和实践的运用。欧美对外关系法的课程多设置一定先决条件,具备国际法、欧盟法知识的学生,更有利于对外关系法的学习;在课程考察上多以考试的方式进行,最终成绩由过程性考核成绩和期末考核成绩组成;在授课方式上多以课堂讲授、学生讨论的方式进行讲授。综合对外关系法的教研情况,我国应将对外关系法的内容纳入国际法学科教育的知识体系之中,在借鉴美国和欧盟对外关系法教材的基础上编撰我国对外关系法教材。我国对外关系法教材的编撰应当重视法律文本的研究,同时引入对比研究的方法,并与典型案例相结合,形成理论性和实践性兼容的对外关系法教材。我国的对外关系法教学应当坚持问题导向,以多元化教学方式开展对外关系法的学科建设。我国对外关系法学科体系建设也需要所有国际法学者的共同努力。Foreign relations law has become a special field of study in the United States and the European Union.Corresponding works and teaching materials have already been published in this field,and foreign universities have already set up courses related to foreign relations law.In terms of the contents of the works,there are significant differences between the contents of the foreign relations law of the United States and those of the European Union.In terms of teaching,foreign relations law courses have been incorporated into the degree programs of many universities in Europe and the United States,and the lecturers are mostly international law scholars with multidisciplinary backgrounds.Also,the foreign relations law courses of American universities are slightly different from those of European Union countries in terms of the content,but in terms of the teaching objectives,they are nearly consistent,focusing on the grasp of the basic theoretical knowledge and the practical application.Both the courses of foreign relations law in Europe and the United States are often set up with certain prerequisites,which require students possess knowledge of international law and European Union law,being more conducive to the study of foreign relations law.The assessment of the courses is mostly carried out by way of examination,and the final grade consists of the process assessment score and the final assessment score.And the teaching is mainly conducted through classroom lectures and studentsdiscussions.Based on teaching and research situation of foreign relations law,China should incorporate the content of foreign relations law into the knowledge system of international law education,and compile foreign relations law teaching materials in China on the basis of the teaching materials of foreign relations law of the United States and the European Union.The compilation of Chinas foreign relations law teaching materials should pay attention to the study of legal texts,introduce the method of comparative study,and combine it with typi
