动态能力理论视角下数字经济时代专利与标准协同研究

摘　　要：数字经济时代,新一代信息技术的飞速发展对专利和标准的协同提出了更高要求。为实现高质量创新发展,数字经济产业必须适应新的时代要求和竞争格局,促进专利与标准的协同演化。基于动态能力理论,我国企业在感知能力方面,存在人才短缺、政策滞后等问题;在捕捉能力方面,存在捕捉路径不明、专利劫持等问题;在重新配置能力方面,存在缺少链长企业、战略布局松散等问题。借鉴美国、欧盟、日本、韩国等代表性国家和地区的国际专利与标准协同的实践经验,构建专利与标准协同竞争力体系。我国政府部门应进一步明确专利与标准协同的改革思路,通过优化顶层设计和注重人才培养来提升企业感知能力,加入技术标准联盟、切换政府角色和多主体联动来提升企业捕捉能力,完善协同发展路径、选择链长企业和完善国际标准化战略布局来提升重构能力,从而推动专利与标准深度融合,助力数字经济产业高质量发展。In the digital economy era,the rapid development of new generation information technology has put forward higher requirements for the coordination of patents and standards.In order to achieve high-quality innovative development,the digital economy industry must adapt to the new era requirements and competition pattern and promote the coordinated evolution of patents and standards.Based on the theory of dynamic capability theory,China's enterprises have problems such as talent shortage and policy lag in perception capability,there are problems regarding capture capability,such as unknown capture paths and patent hijacking,and further more,regarding reconfiguration capability,there are problems such as the lack of long-chain enterprises and loose strategic layout.It draws on the practical experience of international patent and standard collaboration in representative countries or regions such as the United States,the European Union,Japan,and Republic of Korea to build a patent and standard collaborative competitiveness system.China should further clarify the reform idea of collaboration between patents and standards,improve enterprise perception capability by optimizing top-level design and focusing on talent training,improve enterprise capture capability by joining technical standards alliance,switching government roles and multi-subject linkage,and improve restructuring capability by improving collaborative development path,selecting chain enterprises,and improving international standardization strategic layout.To promote the deep integration of patents and standards,and help the high-quality development of the digital economy industry.
