《刑事诉讼法》第四次修改背景下案卷移送制度改革之审思

摘　　要：《刑事诉讼法》第四次修改是再谈案卷移送制度改革的难得契机。我国案卷移送制度历经了“卷证并送主义—复印件移送主义—卷证并送主义”的轮回式改革。当前实行的卷证并送主义虽延续了职权主义的司法传统,对于提升庭审效率、帮助法官把握庭审进程具有较大优势,但在破除法官庭前预断、解决庭审流于形式的问题上无能为力。要想推进庭审实质化和审判中心主义改革的进程,引入“起诉状一本主义”势在必行。因此,在掌握制度运行机理的基础之上,应当立足于前沿视角,以刑事诉讼类型理论为指导,构建“起诉状一本主义”与“卷证并送主义”并存的二元案卷移送制度。如此既可充分发挥卷证并送主义的效率价值,又可在关涉被告人人身权利的案件中阻断法官的庭前预断,从而推进庭审实质化和审判中心主义的改革进程。The fourth revision of the Criminal Procedure Law is a rare opportunity to revisit the reform of the case file transfer system.The system of case file transfer in China has undergone a cyclical reform,transitioning from"conveyance of all dossiers"to"conveyance of copies"and back to"conveyance of all dossiers".While the current practice of"conveyance of all dossiers"continues the judicial tradition of inquisitorialism,it has significant advantages in enhancing trial efficiency and assisting judges in managing the trial process.However,it falls short in eliminating judges'pretrial biases and addressing the issue of trials being mere formalities.To advance the reform process towards substantive trials and trial-centricism,the introduction of the"indictment-only doctrine"is imperative.Therefore,it is essential to establish a dual system of case file transfer,where the"conveyance of all dossiers"and"indictment-only doctrine"coexist,based on a forward-thinking perspective and guided by the theory of criminal proceeding types.This will not only fully leverage the efficiency value of"conveyance of all dossiers"but also prevent judges'pretrial biases in cases involving the defendant's personal rights,thereby promoting the reform process towards substantive trials and trial-centricism.
