摘  要:高校人才有序流动是推进中国高等教育内涵式发展的核心要素。梳理高校教师服务期内辞职争议案件,争议焦点和裁判分歧集中于高校教师在服务期内是否享有预告辞职权、辞职教师应否承担服务期违约金、服务期违约金法律属性为补偿性抑或惩罚性等方面。通过厘清辞职争议法律适用顺位,探究《事业单位人事管理条例》第17条的立法真意,服务期条款不得限制高校教师辞职权的实体权利,应在辞职程序上依法作出限制。高校教师服务期违约金应定性为补偿性违约金,适用情形限于出资培训和特殊待遇两类。The orderly flow of talents in universities is a core element in promoting the connotative development of higher education in China.Sorting out cases of disputes over the resignation of public university teachers during their service period,we find these disputes and the differences in judgment mainly focus on whether university teachers have the right to resign with advance notice during the service period,whether resigned teachers should bear the penalty for breach of contract during the service period,and whether the legal nature of the penalty for breach of contract during the service period is compensatory or punitive.By clarifying the legal application order of resignation disputes and exploring the legislative significance of Article 17 of the Regulations on the Personnel Management of Public Institutions,the terms of the service period shall not limit the substantive right of university teachers to resign,and restrictions shall be made in accordance with the law in the resignation procedure.Legally,the penalty for breach of contract during the service period should be classified as compensatory penalty,and in practice,it should only be applicable to situations related to financed trainings and special treatments.
