民营经济新质生产力发展的法治保障路径

摘　　要：民营经济是中国社会主义市场经济中充满活力和勇于创新的主要成分,是推动“新质生产力”发展的重要力量。目前,我国民营经济新质生产力面临一些制约其高质量发展的因素,这主要表现在政策环境、营商环境、市场竞争和知识产权保护等方面,导致民营经济在实现技术突破、获取优质生产要素、实现产业转型升级上存在相应障碍。为了更好地落实民营经济的平等主体地位、稳定民营企业的发展预期和信心、优化营商环境,需坚定不移地贯彻实质法治理念,从推动法律与政策协同共振、深化“放管服”改革、营造公平竞争的市场环境、完善知识产权制度体系四个重点面向,着力疏通和解决束缚民营经济发展的难点堵点,加快实现民营经济新质生产力的高质量发展。The private economy is a vital and innovative component of China’s socialist market economy,serv-ing as a significant driver for developing“new quality productive forces”.At present,the new quality produc-tive forces of China’s private economy faces some constraints on its high-quality development,which are mainly manifested in the policy environment,business environment,market competition and intellectual prop-erty rights protection,resulting in corresponding obstacles for the private economy when achieving technologi-cal breakthroughs,obtaining high-quality production factors,realizing industrial upgrading and transforma-tion.In order to better implement the equal status of the private economy,stabilize the development expecta-tions and confidence of private enterprises,and optimize the business environment,it is necessary to unswerv-ingly implement the concept of substantive rule of law.We should concentrate on the four key aspects,which involves promoting the synergy between laws and policies,deepening the reform of the release of management and service,creating a fair and competitive market environment,and perfecting the intellectual property rights system.In this regard,we will focus on solving the difficulties that hinder the development of the private economy,and accelerate the development of the new quality productive forces of the private economy.
