忠诚义务视角下律师有效辩护的实证考察与进路思考

摘　　要：在忠诚义务的指引下进行有效辩护不仅是辩护律师的职业使命,也是实现被追诉人合法权益的必然选择。在刑事辩护全覆盖的背景下,要实现辩护从量的提升到质的突破、从形式全覆盖到实质全覆盖,需合理构建以忠诚义务为基础的辩护律师与被追诉人之间的信赖关系。从实践反馈来看,有效辩护的“效”仍有待提升。要释放辩护制度的红利,需要把忠诚义务与有效辩护制度衔接起来,通过完善忠诚义务的职业伦理规范、提升律师质证能力和建立以辩护质量为导向的考核机制等举措实现有效辩护全覆盖。Conducting an effective defense under the guidance of loyalty duty is not only the professional mission of de⁃fense lawyers but also an inevitable choice for realizing the lawful rights and interests of the accused.In the context of com⁃prehensive criminal defense coverage,to achieve a breakthrough in the quality of defense from merely quantitative improve⁃ments and to move from formal to substantive full coverage,it is necessary to reasonably establish a trust relationship be⁃tween defense lawyers and the accused based on loyalty duty.From practical feedback,the'effectiveness'of effective de⁃fense still needs improvement.To unlock the benefits of the defense system,it is essential to integrate loyalty duty with the system of effective defense.This can be achieved through measures such as enhancing the professional ethical standards of loyalty duty,improving lawyers'skills in cross-examination,and establishing an evaluation mechanism oriented towards the quality of defense,thereby realizing comprehensive effective defense.
