数字技术赋能地方立法的优化路径

摘　　要：20世纪90年代立法辅助起草系统被开发应用以来,全球立法工作的数字化转型已历经了电子议会、数字化公众参与、智能立法等阶段。当前,我国地方立法工作面临民主化、科学化、合法性及立法效率提升的多重挑战。数字技术以其方便公众参与、高效利用信息资源、精准识别问题、优化解决方案、提高立法效率、规范立法行为等优势,助推了地方立法的高质量发展。浙江省立法工作的数字化转型经历了建立法律法规数据库、引入办公OA系统并开发地方立法网站、开发立法工作系统、开发规范性文件备案审查系统、建立集成式智能立法系统五个阶段。虽然技术提升了立法的质量和效率,但随着数字技术的深入应用,立法与技术之间的矛盾与不协调性也日益凸显。未来应从以下五方面来优化数字技术赋能地方立法的路径:一是明确数字技术在立法活动中的角色定位;二是提升地方立法工作者的数字素养;三是确立数字赋能地方立法的场景和方向;四是加强立法数字基础设施建设;五是加强地方立法的基础理论研究与数字技术应用产品的开发利用。Since the development and application of legislative drafting assistance systems in the 1990s,the digital transformation of legislative work globally has gone through several stages,including electronic parliament,digital public participation,and intelligent legislation.Currently,local legislative work in China is facing multiple challenges of democratization,scientification,legitimacy,and legislative efficiency improvement.Digital technology,with its advantages of convenient public participation,efficient utilization of information resources,accurate identification of problems,optimization of solutions,improvement of legislative efficiency,and standardization of legislative behavior,has promoted the high-quality development of local legislation.The digital transformation of legislative work in Zhejiang Province has gone through five stages:establishing a database of laws and regulations,introducing Office Automation systems and launching local legislative websites,developing legislative work systems,developing normative documents filing and review systems,and establishing an integrated intelligent legislative system.Although technology has improved the quality and efficiency of legislation,with the in-depth application of digital technology,the contradictions and inconsistencies between legislation and technology have become increasingly prominent.The path of empowering local legislation with digital technology should be optimized from the following five aspects:firstly,clarifying the role and positioning of digital technology in legislative activities;Secondly,enhancing the digital literacy of local legislators;Thirdly,establishing the scenarios and direction for digital empowerment of local legislation;Fourthly,strengthening the construction of legislative digital infrastructure;The fifth is to strengthen the basic theoretical research of local legislation and the development and utilization of digital technology products.
