藏医药文化遗产的人权价值及法律保护

摘　　要：文化遗产关乎人类团结、可持续发展与人权保障。接触和享受文化遗产的权利是文化权利的一部分。文化权利位于人的尊严的核心,是公民权利、政治权利、经济权利、社会权利的促成因素。文化遗产的法律保护,本质上是一个人权法议题。联合国立足人权保护文化遗产方针逐渐被纳入政策法律主流。源自中国的藏医药是惠及世界的重要医疗、经济和文化资源,与平等权、文化权、健康权、生存权、发展权、健康环境权等人权密不可分,具有重要的人权价值。保护藏医药文化遗产,有利于保障人权。联合国教科文组织《保护非物质文化遗产公约》与“世界记忆计划”为藏医药文化遗产提供国际法保护。中国积极缔结、履行联合国教科文组织文化遗产公约,扎实做好藏医药文化遗产的系统性法律保护,推动其创造性转化、创新性发展。社会积极参与藏医药文化遗产的保护,努力建言献策,与政府进行友好的互动、合作。Cultural heritage relates to human solidarity,sustainable development and the protection of human rights.The right of access to and enjoyment of cultural heritage forms part of cultural rights.Cultural rights are at the core of human identity and enablers for civil and political rights as well as economic and social rights.The protection of cultural heritage is essentially a human rights issue.A human rights approach to the protection of cultural heritage has gradually been incorporated into the mainstream of policies and laws.Sowa Rigpa which originated in China is a medical,economic and cultural resource,benefiting the world.It is closely related to human rights such as the right to equality,cultural rights,the right to health,the right to survival and development and the right to healthy environment and has important human rights value.The protection of cultural heritage of Sowa Rigpa is conducive to the protection of human rights.UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage and The Memory of the World Program provide international legal protection for cultural heritage of Sowa Rigpa.China has actively adopted and implemented the UNESCO's conventions on cultural heritage,has systematically protected cultural heritage of Sowa Rigpa according to the law and has promoted the creative transformation and innovative development of Sowa Rigpa.The society has participated actively in the protection of cultural heritage of Sowa Rigpa,has made great efforts to offer advice and suggestions and has interacted and cooperated friendly with the government.
