摘　　要：刑事诉讼司法解释方法论对法治建设具有重要意义,其目的在于提供一种系统性的方法,来探究和解决刑事诉讼司法解释存在的问题。厘清概念是构建刑事诉讼司法解释方法论的前提。其主要概念包括司法解释、司法解释方法论、刑事诉讼司法解释方法论。厘清主要概念应秉持准确性原则、一致性原则以及程序正义原则,同时将建构主义与实在论相结合、系统论与还原论相结合、理论推演与实证方法相结合等方法融入概念厘清中。只有明确司法解释、司法解释方法论、刑事诉讼司法解释方法论及其相关概念的学理边界,才能够恰当地构建方法论,充分发挥刑事诉讼司法解释方法论规范司法解释的积极作用。The judicial interpretation methodology of criminal procedure is of great significance to the construction of the rule of law,and its purpose is to provide a systematic method to explore and solve the problems existing in judicial interpretation of criminal procedure.Clarifying concepts is a prerequisite for constructing the judicial interpretation methodology of criminal procedure.The main concepts include judicial interpretation,judicial interpretation methodology and judicial interpretation methodology of criminal procedure.The principle of accuracy,consistency and procedural justice should be upheld in the clarification of the main concepts,and the methods of combining constructivism with realism,system theory with reductionism,theoretical deduction with empirical method should be integrated into the clarification of concepts.Only by clarifying the theoretical boundaries of judicial interpretation,judicial interpretation methodology,judicial interpretation methodology of criminal procedure and related concepts,can we properly construct the methodology and give full play to the positive role of judicial interpretation methodology of criminal procedure in regulating judicial interpretation.
