论智能时代的算法伦理困境及其治理路径选择——基于罗尔斯正义论视角

摘  要:作为一种重要的人工智能技术代表,算法已经渗透进人们的生产、生活,并产生诸多伦理问题。尤其在当下智能传播环境中,算法权力失衡、算法对隐私的侵犯、算法的归责困境、算法与社会劳动的矛盾等,已日益成为学界关注的伦理议题。算法中的伦理问题说明智能社会中虚拟空间、功利主义、技术治理等会对社会与个体造成不确定的危害,并产生相应的道德决策困境。基于此,本文尝试分析算法伦理困境的具体表现,并从算法判断体系中的数学逻辑、算法的功利主义倾向以及少数科技人才对社会的控制三个方面,进一步探究算法伦理困境产生的主要原因。最后,本文认为可以从无知之幕、分配正义、正义的善出发,尝试在原初状态下建立一种公平的契约环境,从而探索算法世界中的“善法”。As an important representative of artificial intelligence technology algorithms have penetrated human life and work and generated many ethical problems.Especially in the current intelligent communication environment the imbalance of power of algorithms the invasion of privacy by algorithms the dilemma of attribution of algorithms and the contradiction between algorithms and social labour have increasingly become ethical issues of concern to academia.Ethical issues in algorithms reveal how virtual space utilitarianism and technological governance in intelligent societies create uncertain hazards for society and individuals and generate corresponding moral decision-making dilemmas.Based on this this paper tries to analyze the specific manifestations of the ethical dilemma of algorithms and further explores the main reasons for the ethical dilemma of algorithms from three aspects the mathematical logic in the judgment system of algorithms the utilitarian tendency of algorithms and the control of society by a small number of scientific and technological talents.Finally this paper argues that we can try to establish a fair contractual environment in the original state from the perspective of the veil of ignorance distributive justice and the goodness of justice so as to explore‘the good law'in the world of algorithms.
