数字经济时代“算力”的内涵及其刑法保护思考

摘　　要：数字经济时代,算力逐渐成为新型生产力的典型代表,与“算法”“数据”共同构成“数字经济”的发展基石。随着“算力”在数字经济时代发展与应用的扩展与深入,“算力”的内涵由最初的单一计算能力,逐渐演变为囊括计算能力、计算效率、数据处理与算法实现等内容的综合性资源体。随着“侵入系统型”“非法侵占型”与“非法使用型”等各类侵害“算力”行为的涌现,“算力”面临刑事侵害的风险也在不断增加。由于侵害“算力”行为在信息技术面呈现出在物理、逻辑与内容层的侵害多重性,在网络经济面显示出在物质、信息与利益面的侵害多元性,在法益层面表现出“阻挡层”与“背后层”并存的侵害复杂性。故而依据“算力”属性的复杂性与侵害行为的多重性,应当分别从数据与系统安全、知识产权以及财产权利等层面,对“算力”进行刑法的多重性保护。In the era of the digital economy,computing power is gradually becoming a typical representative of the new-quality productive forces,together with“algorithms”and“data”,forming the cornerstone of the digital economy development.With the expansion and deepening of the development and application of computing power in the digital economy era,the connotation of computing power has evolved from initial single computing capability to a comprehensive resource body encompassing computing capacity,computing efficiency,data processing,and algorithm implementation.With the emergence of various types of infringements of computing power,such as“system intrusion”,“illegal usurpation”,and“unlawful”behaviors,the risks of criminal infringement of computing power are continuously increasing.Infringing“computing power”behaviors cause multiple harms physically,logically,and in content in information technology;in the network economy,it displays multiple facets of harm in material,information,and interest aspects,and in terms of legal interests,it demonstrates the complexity of harm with the coexistence of“blocking layer”and“back layer”.Therefore,based on the complexity of computing power attributes and the multiplicity of infringing behaviors,computing power should be subject to multiple protections under criminal law from the aspects of data and system security,intellectual property rights,and property rights.
