摘 要:环境行政公益诉讼原告资格在立法层面仅被赋予检察机关。经多年实践,该制度逐渐暴露出案件来源单一、怠于起诉或选择性起诉、办案能力缺乏、监督困难致环保流于形式及司法地方化等问题,对以上问题进行分析并经必要性和可行性检验后可知,解决问题的关键在于扩张原告资格至社会组织。扩张原告资格至社会组织应结合司法实践,从前置条件、顺位安排与成本保障三方面为其提供制度设计,以促进环境行政公益诉讼制度的良性运转和环境公共利益的真正维护。Legislatively,only the procuratorial organs are conferred the right to prosecute environmental administrative public interest litigation,which have gradually exposed the problems of single source of cases,lack of prosecution or selective prosecution,lack of case handling capability,difficulties in supervision,and localization of justice after years of practice.The right should be also given to the social organs after analyzing and examining the above problems.The expansion of the plaintiff's qualification to social organizations should be combined with judicial practice to provide institutional design for the expansion from three aspects,pre-condition,position arrangement and cost support so as to promote the rule operation of this system and the real protection of environmental public interest.
