侦查人员视角下的犯罪嫌疑人供述决策影响因素探究

摘　　要：犯罪嫌疑人作为刑事案件的被调查对象,其所做出的每一次决策都影响着自身的命运以及案件的整体进展。影响犯罪嫌疑人作出供述决策的因素繁多。扎根理论使研究人员可以通过系统的分析方法对实证资料进行分析和归纳,从而发展概念和建构理论。文章基于扎根理论的研究方法,设计并实施具体的研究步骤,对31名侦查人员进行深度访谈,最后构建侦查人员视角下的犯罪嫌疑人供述决策影响因素的理论模型。通过对模型阐释得知,犯罪嫌疑人的供述决策主要受个人因素、犯罪行为特征因素及情境因素的影响。In a criminal case,every decision made by a suspect affects his or her fate and the overall progress of the case.There are many factors influencing suspects to make confession decisions.Grounded Theory enables researchers to analyze and summarize empirical data through systematic analytical methods,thereby developing conceptual and constructive theories.Based on the research method of Grounded Theory,this study designs and implements specific research procedures,conducts in-depth interviews with 31 investigators,and finally builds a theoretical model of the factors influencing suspects to make confession decisions from the perspective of investigators.Through the interpretation of the model,it is learnt that the confession decision-making of suspects is mainly influenced by personal factors,criminal behavioral characteristics and situational factors.
